MEMORANDUM OPINION
HEYBURN, District Judge.
The Court bifurcated this case and in the summer of 1994 tried the patent validity and infringement claims. See CMI v. Intoximeters, 866 F.Supp. 342 (W.D.Ky.1994). CMI’s remaining common law claims of unfair competition include separate counts for (1) tor-tious interference with contractual relations; (2) tortious interference with prospective business advantage; (3) tortious defamation of business reputation; (4) intentional misrepresentation or fraud; (5) injurious falsehood; and (6) RICO.
