Plaintiffs allege that on June 20, 1986, defendant sought a zoning variance to reduce the sum of setbacks and to enlarge an existing nonconforming structure. The Zoning Board of Appeals of Fairfield (ZBA), after hearing, granted conditionally defendant's application on five conditions, one of which is of significance in the present case, viz: the "house to stay within the footprint" of the existing structure.
