Appeal from a judgment of the County Court of Saratoga County (Scarano, Jr., J.), rendered June 16, 2003, convicting defendant upon his plea of guilty of the crime of attempted assault in the second degree.

On the third day of a trial wherein defendant was being prosecuted on an indictment containing six counts, including rape in the first degree and two counts of assault in the first degree, defendant pleaded guilty to attempted assault in the second degree in full satisfaction of the indictment.
