This case raises the issues of: (1) whether several provisions of Nevada’s recall petition laws violate the Federal and Nevada Constitutions; and (2) whether the procedures of the Nevada Administrative Procedure Act (the “APA”) are to be applied during the judicial review of a Secretary of State’s decision regarding an election petition.
