The plaintiff was the owner of an ice plant near the Union Depot in the city of Raleigh, which was destroyed by fire on 29 August, 1893. Plaintiff alleges that this burning was caused by the negligence of the defendant road. The statement of the case on appeal shows the following facts as admitted or testified to by witnesses:
