Miss Carrie Waldrip, a feme sole, filed suit against J. C. Mytinger, doing business under the firm name of J. C. Mytin-ger Grain Company, alleging injury. She alleged that the defendant owned and operated a milling plant and grain elevator in the city of Wichita Falls, Tex., adjacent to the right of way of the Fort Worth & Denver City Railway Company. That she was in the employ of Carroll, Brought, Robertson & Gates Grocery Company, whose place of business was immediately north of the defendant’s switch track.
