Appellant, State of West Virginia Department of Health and Human Services ( “the DHHR”), appeals from an order entered by the Circuit Court of Randolph County requiring the DHHR to pay Thomas R. Adamski, M.D. the sum of $1,000.00 for a four-hour sexual offender evaluation of Bobby Lee B., a juve'nile delinquent. For the reasons set forth below, we reverse the circuit court’s order.
