The appellant herein, the West Virginia Department of Health and Human Resources (hereinafter referred to as “DHHR”), appeals from orders entered July 30, 2009, and August 24, 2009, by the Circuit Court of Marshall County. Through its order of July 30, 2009, the circuit court required the DHHR to pay the costs associated with the expert witness retained by the minor child’s mother in the underlying abuse and neglect proceeding.
