(after stating the facts as above). This suit is brought to obtain from the defendant the complainant’s proportion'of the profits realized from an order, alleged to have been obtained through Col. Mackie, for shrapnel fuses. The claim arises under the written memorandum signed on Eebruary 20, 1916, and which is hereinbefore set forth. The parties who signed the writing do not agree as to what it means.
