Pending before the Court are Defendants’ Motion to Dismiss Under Fed. R.Civ.P. 12(b)(6) and 12(b)(1) (Docket No. 13), and Plaintiffs Opposition to Defendants’ Motion to Dismiss (Docket No. 24). On April 22, 2009, the Court referred the pending motions to Magistrate Judge Bruce McGiverin (Docket No. 38), for a report and recommendation. Consequently, on August 3, 2009 Magistrate Judge McGiverin entered a Report and Recommendation (Docket No. 43), recommending the Court to grant Defendants’ Motion to Dismiss.
