The plaintiff, John H. Straub, appeals from a judgment on the pleadings entered in favor of the defendants, Oregon Electric Railway Company and Spokane, Portland & Seattle Railway Company.

The facts alleged by the plaintiff in his amended complaint, as the same is further amended by stipulation of the parties, and those admitted in his reply are the following: The defendants own and maintain a certain lead track on Mill street in the city of Salem, from which lead track an industrial spur track extends to the plant of Paulus Canning Company.
