These companion appeals arise from the trial court’s grant of summary judgment to Mountainbrook of Bartow County Homeowners Association, Inc., formerly known as Mountainbrook Property Owners Association (hereinafter “Mountainbrook”). Northside Bank foreclosed on six lots in the Mountainbrook subdivision and when, after several years, Northside did not pay homeowners association assessments on the lots, Mountainbrook filed an action against North-side to foreclose on the property liens and collect the unpaid assessments, interest, late fees and attorney fees.
