Pending before the Court is a motion for summary judgment filed by Defendant Pennsylvania Higher Education Assistance Agency, (“PHEAA”), (Doc. 133), and a motion for partial summary judgment filed by Plaintiffs Anthony Lang, Sr. and Ahkeem Brown, (“Plaintiffs”). (Doc. 139). For the reasons that follow, we shall grant Plaintiffs’ motion to the extent it asserts issue preclusion on the basis of Fourth Circuit decisions finding that PHEAA does not qualify as an arm of the state.
