This is an action by W. A. McNeill to recover of David M. Duller and his wife, Carrie Nell Duller, upon two certain promissory notes, executed by defendants, and secured by the vendor’s lien on separate parcels of land, together with interest and attorney’s fees. Upon trial with a jury, at the conclusion of the evidence, the court instructed the jury to return a verdict for plaintiff against both defendants for the amount due upon said notes, including interest and attorney’s fees, and for foreclosure of the lien as prayed for, also for the insurance premium paid, which was done, and judgment…
