KENNEDY, Circuit Judge.
Joseph A. Wittstock, III, (Plaintiff) appeals the district court’s dismissal of his complaint for lack of subject matter jurisdiction and failure to state a claim upon which relief can be granted. For the foregoing reasons, we AFFIRM the judgment of the district court.
