Appellant Simonne Phelps claims that she was dismissed from her nursing position at the Catholic Medical Center (CMC) 1 in violation of Title I of the Americans with Disabilities Act (ADA), 42 U.S.C. § 12101 et seq., and § 504 of the Rehabilitation Act, 29 U.S.C. § 794(a), 2 The district court ruled on summary judgment that Phelps was not a “qualified individual with a disability” because she could not perform the “essential functions” of her job “with or without reasonable accommodation.” Phelps v.
