MEMORANDUM AND ORDER
LAGUEUX, District Judge.
This matter is before the Court on cross motions for summary judgment, and on defendant’s motion to dismiss Count 1 of plaintiff’s complaint based upon the pleadings, pursuant to Fed.R.Civ.P. 12(c). The dispute concerns an $18 million commercial loan issued by Fleet National Bank (“Fleet”) to Anthony Liuzzo (“Liuzzo”), a nursing home operator, in 1988. Plaintiff here, Banco Totta e Acores (“BTA”), participated in that loan in the amount of $2 million.
