This is an appeal on questions of law from a judgment of the Municipal Court of Cleveland, Ohio, rendered upon a jury verdict in favor of the plaintiff.

On the night of January 23, 1960, between 8:00 and 9:00 P. M., plaintiff, on his retuurn to his home from the corner store and while proceeding in a southerly direction on the easterly sidewalk of East 79th Street, tripped and fell over the bottom-most step of three steps which led up from the public sidewalk to the walk-way leading to the house next door to plaintiff’s home.
