Appellees, the county judge and the county commissioners comprising the commissioners’ court of Kendall county, Tex., acting as the duly authorized agency of the state of Texas, instituted this proceeding to temporarily restrain appellant from interfering in any manner with the state of Texas and ap-pellees in surveying and constructing a state highway across appellant’s land. Appellant answered, resisting the restraining order, and himself prayed for an order restraining appellees from surveying and constructing the highway, because of certain alleged irregularities in the condemnation…
