Robinson, J. —

Richard N. Bond, plaintiff below, alleged that, while he was crossing a Walla Walla street intersection on foot, a family car, driven by Darrell P. Ovens, a son of the defendants, negligently collided with him, to his damage in the sum of six thousand dollars. A jury returned a verdict for the defendants. The trial court overruled the plaintiff’s motion for judgment notwithstanding the verdict, but granted his alternative motion for a new trial. The defendants have appealed from that portion of the order which reads as follows:
