The plaintiff in error, hereinafter called defendant, was convicted in the county court of Okfuskee county on the charge of having the unlawful possession of a still, and was sentenced to pay a fine of $500 and to serve a term of 90 days in the county jail.
The record discloses that defendant had leased for agricultural purposes, and was in possession of certain premises upon which a still in operation was found. Defendant testified that he subleased the land on which the still was found to one Middleton. At the time the still was found, both defendant and Middleton were at it, apparently…
