MEMORANDUM OPINION

This matter is before the Court on defendant’s motion for summary judgment. 2 Having considered the motion, plaintiffs opposition thereto and the entire record of the case, defendant’s motion will be granted.
I. BACKGROUND
Plaintiff was arrested on June 18, 1992, and a grand jury indictment setting forth two charges against him was filed on June 30, 1992 “in the [United States District Court for the Southern District of New York], docket entry No. 62.” Compl. at 5.
