This action was commenced in the district court of Kiowa county, Okla., by E. W. Capps, plaintiff herein, agajnst the Insurance Company of North America, defendant herein. James Burns, B. B. Burns, and A. J. ¡Beardain were made additional parties defendant upon motion of defendant, plaintiff, for his cause of action against the defendants, in his first cause of action says:

“Eirst Cause of Action.
