This cause involves an appeal by James B. Benson, who was plaintiff in the lower court, from a jury verdict and judgment thereon in favor of the defendants in the Circuit Court of Madison County, Tennessee. For convenience the parties will be styled, as in the lower court, plaintiff and defendants or by their respective names.
