STEPHENS, Associate Justice.

Action for damages resulting from delay in the transmission and delivery of a death message. The objections urged to the first, second, and third assignments of error, for not being briefed as required by the rules, under repeated rulings we must sustain.

The fourth, fifth, and ninth assignments raise in different forms the important question in the case, which is, in effect, whether of not the court should have instructed a verdict against appellee upon the ground that, to quote from one of the assignments, “the uneontradicted testimony showed that said message was…
