*626The appellee Mink, who was plaintiff below, on August 16,1914, was in the employ of the appellant, Louisville & Nashville Bailroad Company, defendant below, as brakeman on a freight train. The crew consisted of an engineer, fireman, conductor, and a rear and front end brakeman, the plaintiff filling the latter position. In approaching a stop it was usually the duty of the front brakeman especially to be on top of the train for the purpose of either giving or receiving necessary signals to or from other members of the crew.
