INTRODUCTION

This proposed class action claims that Bank of New York Mellon, N.A. ("BNY Mellon"), breached its fiduciary duty to its trust beneficiaries by charging excessive and undisclosed fees for the preparation of the trusts' tax returns. The plaintiffs have moved for certification of a class, and both parties have moved for summary judgment. After a hearing, the Court ALLOWS IN PART and DENIES IN PART the motion for class certification (Dkt. No. 285). BNY Mellon's motion for summary judgment (Dkt.
