This case is predicated upon plaintiff’s alleged right to commission earned upon sale of certain lands and personal property thereon in Fergus county, belonging to the defendant. The cause of action is stated by plaintiff in two counts, the first on contract, and the second on the quantum meruit. Upon issues joined, the cause was tried to the court without a jury. The court found and determined all of the issues in favor of the plaintiff, and judgment was given and made for the plaintiff in the sum of $23,758.20, together with costs. *15The appeal is from the judgment and order denying…
