Plaintiff, as a veteran entitled to the benefits of the Servicemen’s Readjustment Act of 1944, Public Law 346,' Laws of the 78th Congress, 2d Session, a part of what is popularly known as the “G. I. Bill of Rights,” brought this action to recover the value of subsistence benefits under that act, • which defendant allegedly promised *676would be paid. He, as assignee, joined with his own cause of action the cause of three other veterans seeking a like recovery. Issues were made and trial had to a jury. At the close of all the evidence, both plaintiff and defendant moved for an instructed verdict.…
