In this grievance arbitration appeal, this Court granted limited review to consider whether a pending grievance filed in opposition to an Act 1111 employee’s termination is rendered moot where the employee fails to attempt to grieve a separate and subsequent set of charges which also seek his termination.2 The proper resolution of this appeal, however, requires consideration of an important predicate question: the level of deference due to the arbitrator’s decision on mootness.
