This appeal involves a suit to condemn an easement or right-of-way to access landlocked property. The plaintiff named as defendants all neighboring landowners, including the State of Tennessee and the Town of Smyrna. The State and the Town filed motions to dismiss, asserting sovereign immunity. The trial court denied the motions to dismiss but granted the State and the Town permission to seek an interlocutory appeal.
