This suit was brought by the Automobile Sales Company in the Circuit Court to recover gasoline taxes which had been paid under protest to the Commissioner of Finance and Taxation. The Commissioner and the constable, J. C. Johnson, who served a distress warrant issued by the Commissioner to compel payment of the tax, and the surety upon the bond of the constable, were made parties defendant.
