HALL, Chief Justice.

The appellant company, as the executor of the estate of R. E. Brooks, deceased, brought this suit September 7, 1933, against Amarillo Bank & Trust Company, E. C. Brand, banking commissioner, and certain shareholders and depositors of the First State Bank of Amarillo, alleged to be a defunct banking corporation organized under the laws of Texas with a capital stock of $50,000 divided into 500 shares of $100 each.
