RAYFIEL, District Judge.

This is a motion for summary judgment in favor of the defendant, dismissing the complaint herein, or, in the alternative, for an order dismissing the action, because the complaint fails to state a claim against the defendant upon which relief can be granted.

The action is brought under the Federal Tort Claims Act, 28 U.S.C.A. §§ 1346, 2671 et seq., to recover damages for personal injuries sustained by the plaintiff, Agnes Faleni, as a result of the negligence of an employee of the defendant, and to recover damages sustained by the plaintiff Alfred Faleni, for medical…
