Plaintiff in error Ivan Johnson, defendant below, was charged by information in the district court of Beaver county, Oklahoma, with the commission of the crime of operating a motor vehicle while intoxicated on the public highways of said county on January 24, 1951, “after being formerly convicted of operating a motor vehicle while under the influence of intoxicating liquor upon the public highways of the State of Oklahoma”.
