The plaintiff1 in error, hereinafter called defendant, was convicted in the district court of Osage county on a charge of driving a car while intoxicated, and was sentenced to serve a term of 6 months in the State Penitentiary and to pay a fine of $500.

The first assignment of. error argued is that the court erred in overruling defendant’s application for a continuance.
