Gentry, and Maurice Weightman and Jess K. Mackey were charged jointly with the murder of Thomas J. Géntry, alleged to have been committed in Oklahoma county, on the 6th day of January, A. D. 1912, by shooting with a pistol.

Gentry, and Maurice Weightman and Jess K. Mackey were charged jointly with the murder of Thomas J. Géntry, alleged to have been committed in Oklahoma county, on the 6th day of January, A. (after stating the facts as above). Reviewing the assignments of error relied upon for a reversal of the judgment in their natural sequence, rather than in the order of their presentment in argument, the first question is: “Did the court err in refusing to grant a change of venue?” The application was supported by the affidavits of the plaintiff in error and 30 residents of Oklahoma county. The ground set up in the application was that the minds of the inhabitants of Oklahoma county are so prejudiced against the defendant that she cannot obtain a fair and impartial trial in said county.
