August 31, 1931, appellee, B. F. Goodrich Rubber Company, sued appellant, W. A. O’Neal, and Tom O’Neal, as partners, doing business under the name of Red Ball Garage, to recover $353.50, balance due on account for merchandise. September 21, 1931, judgment by default was entered against "W. A. O’Neal and Tom O’Neal in accordance with the prayer of the complaint.
