OPALA, Justice:

The narrow first-impression issue presented is whether an appeal may be prosecuted from what is known, in lawyer’s parlance, as a “partial summary judgment”. The disposition in question, rendered under Rule 13, Rules for the District Courts of Oklahoma, 12 O.S.1971, Ch. 2, App., determines one, but not all, issues raised by plaintiff’s petition alleging a single cause of action in negligent tort.
