This case comes before the court without oral argument on plaintiffs’ motion, filed April 6,1973, moving that, pursuant to Rule 141 (b), the court adopt the recommended decision filed February 28, 1973, by Trial Commissioner Mastin G. White under Rule 134(h), defendant *750having failed to file a notice of intention to except and the time for so filing under the rules of the court having expired.
