Reversing upon tke original appeal and affirming'upon the cross-appeal.
In May, 1904, the appellant was convicted of manslaughter and his punishment fixed at confinement in the penitentiary for eight years. Just before he was taken from the jail at Pikeville to the penitentiary at Prank-fort, he conveyed his farm of 500 acres or more to his wife, without valuable consideration or her knowledge, had the deed recorded, and directed the clerk to deliver same to her, which he did the next day.
