This action is brought pursuant to section 505(a)(2) of the Federal Water Pollution Control Act, as amended, otherwise known as the Clean Water Act, 33 U.S.C. § 1251 et seq. (CWA), and the Administrative Procedure Act, 5 U.S.C. § 701 et seq. (APA).
