The accused was tried by general court-martial in Korea upon specifications of premeditated murder, murder committed in the attempted perpetration of a felony, and of rape. He was acquitted of premeditated murder but found guilty of felony murder and rape, and was sentenced to a dishonoi'able discharge, total forfeitures and confinement at hard labor for life. The convening authority approved, but for reasons hereinafter set forth, a board of review reduced the finding of guilty *125of felony murder to voluntary manslaughter. After reassessment for…
