OPINION

MORRISON, Judge.

The offense, driving an automobile • on a public highway while intoxicated. Trial was had before the court and the punishment assessed at three (3) days in jail and a fine of $125.00.

The evidence reflects that on June 21, 1968, at approximately 8:00 P.M., Officer Wilson of the Dallas Police Department was dispatched to investigate an accident in the 1700 block of North Henderson Street, a public thoroughfare in Dallas.
