The facts are sufficiently stated in the opinion of the Court by Mr.Justice Walker. The defendant Davenport and seventeen others were indicted and convicted, in the court below, of forcible trespass in tearing down three shacks, which had been erected in a lumber or logging camp, and which were each about 10 feet long and 7 feet wide, made of poles and covered with tar paper, and had been built upon the land two or three days before the alleged trespass.
