Following a jury trial, defendant was convicted of second-degree assault (Count l).1 ORS 163.175.2 On appeal from the resulting judgment, defendant raises six assignments of error. We reject without discussion defendant’s first and second assignments of error. Furthermore, in light of our resolution, discussed below, of defendant’s fifth and sixth assignments of error, we do not address his third and fourth assignments in which he challenges testimony elicited from a police officer regarding the permissible use of force or deadly force in response to provocation.
