SAND, Justice.

Dan Joe Denny, defendant, was found guilty by a jury of having delivered a controlled substance in violation of North Dakota Century Code §§ 19-03.l-23(l)(b) and 19-03.l-05(4)(o). The judge sentenced him to five years in the State Penitentiary. A criminal judgment was entered accordingly, from which the defendant appealed.
