HEANEY, Circuit Judge.

The appellant was convicted by a jury of two counts of violating 21 U.S.C. § 841(a)(1), by selling heroin. The first sale was to a police undercover agent (Crosby) on November 13, 1972, and the second to a paid informer (DuPree) on November 16, 1972. The sole issue on appeal is whether the District Court erred in failing to dismiss the indictment, brought over eleven months after the dates of the offenses.
