Jackson et al., as citizens and taxpayers, brought suit against the City of Rome, seeking to restrain and enjoin the defendant from performing a contract made between the State Highway Board of Georgia and the defendant and from expending any. of the public funds of the city for the purchase of a right of way and for the payment of consequential and direct damages to all parties involved, by reason of the construction of a State highway through the city.
