First Interstate Bank of Texas (First Interstate) sued First National Bank of Jefferson Parish (FNJ) for breach of a bond purchase agreement. FNJ claimed the benefit of the D’Oench, Duhme doctrine and moved for summary judgment. 731 F.Supp. 746. The district court denied the motion, and FNJ cross-appealed. We affirm that ruling. At trial, the district court concluded that First Interstate produced insufficient evidence to present a jury question that FNJ Senior Vice President John Boyd had authority to execute the bond purchase agreement for FNJ.
